7. What assets can the IRS seize?

The IRS engages in seizures all the time. Bank levies and wage garnishments are two common examples. Seizures of taxpayers’ assets are authorized by the Tax Code and reinforced by numerous Tax Court cases. When a seizure of a taxpayer’s asset does occur, the effects can be devastating. The settlement and offer-in-compromise (OIC) program, sometimes referred to as the IRS Fresh Start Program, allows the IRS to settle a tax debt for less than the amount owed. 18. Can IRS back taxes be discharged in bankruptcy?

It depends. When it comes to bankruptcy and tax liabilities, timing is everything. In general, tax debt may be dischargeable if the tax assessment is at least 240 days old, the tax return was filed at least two years ago, the due date for filing the tax return is at least three years ago, the tax return is not fraudulent, and the taxpayer is not guilty of tax evasion.
